All sales of Guinefort Education’s online products are handled exclusively by Digistore24.com, the payment service provider, to ensure both convenience and security of payment. For all Guinefort Education online trainings offered by Guinefort Education OG the terms and conditions of Digistore24.com apply.

 

1. Preamble

These Terms and Conditions (T&C) apply to all orders and interactions ofGuinefort Education OG. They regulate the legal relationship between the customer and Guinefort Education OG.

 

2. Contract

2.1 The use of online trainings from Guinefort Education is chargeable and distributed via Digistore24.com. The contract is completed online by filling out the necessary data, clicking the button and expression of consent of the end user.

2.2

The contract language is English.

 

3. Technical requirements

The customer must ensure that technical and actual conditions for the receipt of the products are given on their side. These are to own proper hardware and the ability to download the content provided (video and writing). It is also up to the customer to provide suitable software that enables proper opening, management, editing and printing of files and content.

 

4. Customer care

4.1 Guinefort Education OG provides customer support in the event of technical problems with the products between 09:00 and 17:00 from Monday to Friday. Please contact INFORMATION when in need of technical support.

 

4.2 Technical assistance is provided in written or oral form. If the technical problem cannot be solved and professional support is needed, the customer must provide for this.

 

4.3 Should complaints arise, the email address EMAIL Education and the telephone number PHONE are to be used.

 

Usage

5.1 Participants of Guinefort Education’s Online Training can post comments under blog articles. There is no claim to the publication of the comment written by the user.

 

5.2 Guinefort Education reserves the right not to publish comments or to remove already published comments from the website without giving reasons and without notification. The user is liable for the fact that the comments provided by him do not interfere with any third-party rights of competition, trademark, personality, copyright or other rights.

 

5.3 The User agrees not to send any comments that are offensive, improper, indecent or racist; cause disruption, interruption or excessive burden for Guinefort Education; not to promote any type of violence against groups or individuals; include passwords and electronic keys that are not public; ask other users to provide passwords, electronic keys or personal information; no links to websites that violate these rules of conduct; information and / or data about the personal area of life of persons; insult and threaten people or groups; contain untrue content about people or groups; generated by automatic scripts or programs (bots); violates contractual or other rights of third parties; comments that could affect the functionality of hardware and software; violate the applicable laws and regulations of Austria.

 

5.4 The user grants Guinefort Education a right to use the comments made by the user to the extent that Guinefort Education may publish the comments in its own print and online media as well as by the cooperation partners of Guinefort Education.

 

5.5 The user assumes all costs incurred by Guinefort Education due to infringement of third party rights in connection with user-provided comments. This includes the costs of legal defence. This does not affect all further rights and claims for damages of Guinefort Education against the user.

 

5.6 Users and affected individuals who feel that their rights have been infringed by a comment can report these potential interventions to Guinefort Education at any time by sending an e-mail to EMAIL.

 

 

Prices / Payment

6.1 Guinefort Education OG offers products partly free of charge, partly for a fee. The prices result from the respective product description page and / or the respective order form.

 

6.2 Guinefort Education OG offers selectable payment modalities. These result from the respective product description and / or the respective order form. When placing the order, the customer must ensure that the details of all data match the desired data on the invoice. Subsequent changes to invoices cannot be made.

 

6.3 The customer is not entitled to withhold payments, unless he is entitled to a legal right of retention from the same contractual relationship.

 

7. Due date / default

 

7.1 All agreed payments are due immediately upon conclusion of the contract. There is a delay if a debit of the purchase price or a corresponding credit card charge fails or the debit or credit card charge is cancelled by the customer without legal reasons.

 

7.2 If the customer is in default, Paulina Adamczyk e.U. will charge a flat rate of EUR 3.00 per reminder as arrears damage. The assertion of a further damage caused by delay remains reserved. The customer is free to prove that no damage or a much lower damage occurred.

 

8. Payment modalities

 

8.1 Guinefort Education OG may use third-party services to process payments. If this happens, the contracted company will be named in the order process.

 

8.2 For payments by direct debit the following applies: The customer must ensure that the specified bank details are correct, that he is authorized to dispose of the bank account and that the bank account has adequate coverage at the time of debiting. Costs for failed debits, in particular return debit and reminder fees, will be charged to the customer, unless Guinefort Education OG or digistore24 GmbH are responsible for the failure.

 

9. Cancellation policy

 

9a. Cancellation policy for the purchase of digital content that is not delivered on a physical medium (downloads) – including software purchased as a subscription

 

9.1 Right of withdrawal

 

You have the right to withdraw from this contract within fourteen days without giving any reason. The revocation period is fourteen days from the date of the contract. To exercise your right of withdrawal, you must inform Guinefort Education OG Schüttelstraße 85/16 1020 Vienna, +43 (0) 676 77 31 657, office@guinefort-edu.com by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached withdrawal form, which is not a requirement. You can also electronically complete and submit the withdrawal form or any other unequivocal statement on our website. If you make use of this option, we will immediately send you (e.g. by e-mail) a confirmation of the receipt of such a revocation. In order to maintain the cancellation period, it is sufficient for you to send the notification of the withdrawal before the expiry of the withdrawal period.

 

9.2 Consequences of the revocation

 

If you withdraw from this agreement, we have to refund all payments we have received from you, including delivery charges (except for the additional costs arising from choosing a different delivery method than the most favourable standard delivery) immediately and at the latest within fourteen days from the date on which the notification of your revocation of this contract has reached us. For this refund we will use the same means of payment as you used in the original transaction, unless otherwise expressly agreed with you; In no case will you be charged for this refund fees.

 

9b. Exclusion of the right of withdrawal after execution of the contract

 

The consumer has no right of withdrawal for the delivery of digital content not stored on a physical medium ifGuinefort Education OG has started to deliver before the expiry of the otherwise existing withdrawal period. This is done with the express consent of the consumer, associated with his knowledge of the loss of the right of withdrawal in the event of premature commencement of the contract and after provision of a copy or confirmation in accordance with § 7 para. 3 FAGG.

 

According to § 7 para. 3 FAGG the consumer is within a reasonable period after the conclusion of the contract, but at the latest before the start of service, a confirmation of the contract on a durable medium (e.g. e-mail) connected to the information mentioned in § 4 para 1 FAGG provided that this information has not been previously provided on a durable medium. In any case, the confirmation of the contract contains a confirmation of the consent to the immediate provision of the service and of the consumer’s knowledge of the right of withdrawal caused. ”

 

You bear the entire risk of loss after purchase and loss of the digital content you download, including loss due to computer or hard drive failure.

 

10. Partner offers, links

 

Guinefort Education OG also provides the customer with links to third-party sites and / or partner offers. There is no contractual relationship with Guinefort Education OG. The respective terms and conditions of the operators of the linked third party / partner offers apply.

 

11. Copyright

 

All copyrights, usage and other intellectual property rights for the products of Paulina Adamczyk e.U. remain with Guinefort Education OG. All copyrights, usage rights and other proprietary rights to third-party products remain with them. The user may only use the products for their own purposes and is not entitled to make them available to third parties on the Internet or in any other way, be it for consideration or free of charge, unless the purpose of the products so dictates. The commercial duplication and the resale of the products are excluded.

 

12. Warranty, liability

 

12.1 The statutory warranty provisions apply.

 

12.2 The online products and advice of Guinefort Education OG serve as a guide and in no way replace expert veterinary advice. The customer should therefore consult veterinary advice if necessary, before using the knowledge acquired from the online products.

 

13. Scope

 

Austrian law applies. The UN sales law is excluded.

 

14. Final provisions

 

 

14.1 Guinefort Education OG is entitled to amend these Terms and Conditions insofar as this is necessary to eliminate subsequently arising equivalence disturbances or to adapt to changed legal or technical conditions.

 

14.2 The Terms and Conditions are therefore to be read again before each conclusion of contract. You have the opportunity to print out the current terms and conditions for your records. Storage of contract data by Guinefort Education OG does not take place.

 

14.3 Customers of a subscription will be informed by e-mail about the change and its content of the Terms and Conditions. You have the possibility to contradict the new general terms and conditions within 4 weeks in text form. The objection must be sent to: EMAIL or by mail to: Guinefort Education OG, Schüttelstraße 85/16, 1020 Vienna. If the customer exercises his right to object, Guinefort Education OG is entitled to terminate the contract with a notice period of 6 months.
